Acceptance of Terms

Welcome to CARESPHERE WELLNESS ("we," "our," "us"). By accessing or using our website (www.carespherewellness.co.ke), booking consultations, purchasing products, or engaging our health governance services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services or website.

Health Governance Services

CARESPHERE WELLNESS provides health advisory, care coordination, and preventive health oversight services. Our services include but are not limited to:

• Executive Health Risk Assessments
• Ongoing Health Advisory & Care Coordination
• Premium Concierge Health Support
• ReproHub Maternal & Preconception Advisory
• Diaspora Family Support Services
• Corporate Health Governance Programs

All services are provided by or under the supervision of qualified clinical personnel registered with the Kenya Medical Practitioners and Dentists Council (KMPDC). Our services are advisory and coordinative in nature and do not replace emergency medical care or primary physician relationships.

Consultations & Health Assessments

When you book a consultation or health risk assessment:

• You agree to provide accurate, complete, and current health information.
• You understand that health assessments are screening tools and not diagnostic medical examinations.
• You acknowledge that recommendations provided are based on the information you share and may require follow-up with primary care physicians.
• Cancellations must be made at least 24 hours in advance to avoid fees.
• No-show appointments may incur a cancellation fee of up to 50% of the consultation fee.

E-Commerce & Product Sales

Our wellness marketplace offers ergonomic and rehabilitative products. By purchasing products:

• You confirm that you are at least 18 years of age.
• Product descriptions, images, and prices are subject to change without notice.
• We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion.
• Medical products (e.g., blood pressure monitors, TENS units) are intended for home use and should not replace professional medical advice.
• Prescription-required items will be clearly marked and require valid prescription upload before shipment.
• Delivery timelines are estimates; we are not liable for carrier delays.

Payments & Fees

• All fees are quoted in Kenyan Shillings (KES) and are inclusive of applicable taxes (VAT where applicable).
• Payments are processed via secure payment gateways (M-Pesa, credit/debit cards, bank transfers).
• We do not store full payment card information on our servers.
• Service fees are due at the time of booking unless otherwise agreed in writing.
• Late payments may result in suspension of services.
• We reserve the right to change pricing with 30 days' notice posted on our website.

Cancellation & Refund Policy

Consultations & Services: Cancellations made 24+ hours before scheduled appointment receive full refund. Cancellations within 24 hours receive 50% refund. No-shows forfeit the full fee.

Products: Unopened, unused products may be returned within 14 days of delivery for a full refund (excluding shipping costs). Opened or used medical devices cannot be returned for hygiene and safety reasons. Defective products are covered by manufacturer warranty.

Telehealth & Remote Services

Telehealth consultations are provided via secure video platforms (Google Meet, Zoom, Teams). You agree to:

• Ensure a private, quiet environment for the consultation.
• Provide accurate health information to the best of your knowledge.
• Understand that telehealth has limitations and may not be suitable for emergencies.
• Consent to the recording of sessions for quality assurance (recordings stored securely and deleted after 30 days unless required for legal purposes).

Limitation of Liability

To the fullest extent permitted by Kenyan law:

• CARESPHERE WELLNESS provides services "as is" without warranties of any kind, express or implied.
• We do not guarantee specific health outcomes or results.
• Our liability for any claim arising from our services or products is limited to the total fees paid by you in the 6 months preceding the claim.
• We are not liable for indirect, incidental, or consequential damages, including lost profits or medical complications arising from third-party provider actions.
• You acknowledge that health decisions are ultimately your responsibility and should be made in consultation with your primary physician.

Intellectual Property

All content on this website — including text, graphics, logos, icons, images, videos, and software — is the property of CARESPHERE WELLNESS or its licensors and is protected by Kenyan and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

You retain ownership of your personal health information, but grant us a license to use it for service delivery and improvement purposes as described in our Privacy Policy.

User Conduct

You agree not to:

• Use our website or services for any unlawful purpose.
• Impersonate any person or entity or provide false information.
• Interfere with or disrupt our website or servers.
• Attempt to gain unauthorized access to any portion of our systems.
• Upload viruses or malicious code.
• Harvest or collect user data without consent.

Violation of these provisions may result in immediate termination of your account and legal action.

Third-Party Links

Our website may contain links to third-party websites (hospitals, insurance providers, payment gateways). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms.

Termination

We reserve the right to suspend or terminate your access to our services at any time, without notice, for conduct that violates these Terms, harms our business interests, or is otherwise objectionable. Upon termination, you remain liable for any outstanding fees or obligations incurred prior to termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

Key applicable laws include: Kenya Data Protection Act (No. 24 of 2019), Medical Practitioners and Dentists Act (Cap 253), Health Act (No. 21 of 2017), and the Consumer Protection Act.

Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at Carespherewellness@gmail.com. If the dispute cannot be resolved within 30 days, either party may submit the matter to binding arbitration under the Nairobi Centre for International Arbitration (NCIA) rules. Arbitration shall be conducted in Nairobi in English.
